Terms of Service
These Terms govern access to Habesha Agenagn. By creating an account, posting, requesting, accepting, or providing a service, you agree to them.
1. Platform role
Habesha Agenagn is a technology platform that helps users find and communicate with other users. It is not an employer, employment agency, landlord, property manager, real-estate broker, motor carrier, freight forwarder, airline, taxi or limousine company, insurer, event organizer, seller, manufacturer, or professional service provider. Except where the platform expressly states otherwise, agreements are between users.
2. Eligibility and accounts
You must be at least 18 and legally able to enter contracts. Provide accurate information, protect your login, use one account, and promptly update changes. You are responsible for activity under your account. We may verify information but do not guarantee a user's identity, qualifications, history, license, insurance, property, vehicle, goods, or listing.
3. User responsibilities
Before a transaction, independently inspect and verify the other user, listing, price, documents, licenses, insurance, permits, ownership, condition, and legal requirements. Use written agreements when appropriate. Never rely on the platform as a substitute for legal, tax, immigration, employment, housing, transportation, customs, safety, or insurance advice.
4. Payments—no custody of user money
Habesha Agenagn does not provide escrow, hold transaction funds, store balances, or safeguard money owed between users. Users pay only for the service or item they choose and make payment directly to the other user or through an independent third-party payment provider. A separate platform fee may apply only if clearly disclosed before purchase. Payment providers have their own terms. Habesha Agenagn is not responsible for chargebacks, failed payments, stolen payment methods, taxes, refunds, or money transferred between users.
5. Service-specific rules
Shipping users must obey airline, TSA, customs, import/export, baggage, and prohibited-item rules and document handoff, condition, weight, value, and delivery. Drivers, vehicle owners, truckers, and carriers must maintain all licenses, registrations, permits, inspections, insurance, and legal authority. Property users must follow fair-housing and landlord-tenant laws. Employers and providers control hiring, wages, taxes, classification, licensing, safety, and work. Sellers are responsible for lawful ownership, authenticity, safety, condition, recalls, and descriptions. Event organizers control venue safety, permissions, tickets, cancellations, and refunds.
6. Content and conduct
You retain ownership of content you submit and grant Habesha Agenagn a worldwide, nonexclusive, royalty-free license to host, reproduce, format, display, and distribute it only to operate, promote, secure, and improve the platform. Do not post illegal, false, discriminatory, abusive, infringing, private, dangerous, counterfeit, stolen, or deceptive content. Do not manipulate reviews, impersonate others, spam, scrape, evade enforcement, or interfere with security.
7. Moderation and account action
We may review, preserve, restrict, remove, or report content; limit features; cancel listings; and restrict, suspend, or close accounts when reasonably necessary for safety, law, these Terms, or platform integrity. We are not required to monitor every listing or private interaction. Users may report concerns through the platform or contact email.
8. No warranties
The platform and all user content are provided “as is” and “as available.” To the maximum extent permitted by law, Habesha Agenagn disclaims implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, and guarantees of availability, accuracy, safety, quality, legality, identity, delivery, employment, housing, payment, or results.
9. Limitation of liability
To the maximum extent permitted by law, Habesha Agenagn is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, data, opportunities, or goodwill; or injury, death, property loss, cargo loss, theft, fraud, discrimination, accidents, disputes, or conduct of users or third parties. Total platform liability for a claim will not exceed the greater of $100 or platform fees paid directly to Habesha Agenagn by the claimant during the 12 months before the event. These limits do not apply where prohibited by law and do not exclude liability that cannot legally be waived.
10. Indemnity
To the extent permitted by law, you will defend and indemnify Habesha Agenagn and its operators from third-party claims, losses, penalties, and reasonable legal costs arising from your content, transaction, conduct, property, goods, services, taxes, law violations, or breach of these Terms, except to the extent caused by liability that cannot legally be shifted.
11. Disputes and governing law
Contact habeshaagenagnapp@gmail.com first and allow 30 days for informal resolution. Georgia law governs, without overriding mandatory consumer protections. Unless applicable law requires otherwise, disputes must be brought in state or federal courts serving DeKalb County, Georgia. You may still report matters to regulators or law enforcement.
12. Changes and contact
We may update these Terms prospectively. Material changes will be announced and may require renewed acceptance. Continued use after the effective date means acceptance where legally permitted. Contact: habeshaagenagnapp@gmail.com.
